GENERAL CONDITIONS
Welcome to Halal Sailing Adventures. We invite you to review these General Conditions carefully before booking your sailing experience. By making a reservation, for our premier 4- days, 3-nights charter or our 1 day excursion, you confirm your acceptance of our terms and conditions. Should you have any questions or require clarification on any point, please feel free
to reach out to us directly.
Booking Confirmation and Required Documentation
- Booking Confirmation: Your payment for the 4- days, 3-nights sailing adventure or one -day excursion with Halal Sailing Adventures (established under Back 2 Basics d.o.o.) signifies your understanding and acceptance of these terms and conditions.
- Group Organizer Responsibility: Upon booking, the group organizer must complete a group booking form detailing each traveler’s information. The group organizer is responsible for ensuring that all members of the party have read and agreed to these terms.
- Traveler Documentation: Each traveler must provide a passport copy to Halal Sailing Adventures along with the completed group booking form. The group organizer will serve as the primary contact for Halal Sailing Adventures and is responsible for keeping all travelers informed of sailing, transfer, and travel arrangements.
Itinerary and Skipper Authority
- Custom Itinerary with Flexibility: While we plan each itinerary with care, unforeseen conditions may require adjustments. The skipper has the authority to modify the route for safety reasons, including weather changes or unforeseen marina conditions.
- Guest Requests for Itinerary Changes: If the group collectively requests an itinerary change, it will be at the skipper’s discretion to accommodate these preferences.
Note: Cancellations are non-refundable, but clients may be able to file a claim through their travel insurance provider.
Embarkation and Disembarkation Procedures
Arrival and Check-In: Check-in times for our premier charter is 3pm on the day before we sail. A safety briefing will be conducted at check-in.
- Failure to Arrive: If guests do not arrive by the designated check-in time, the booking will be marked as “failed to arrive,” and the trip will be canceled without refund.
- Disembarkation: Our premier 4- days, 3-nights charters end at 5:00 p.m. (17:00), with arrival at Drage base port by 4:00 p.m. (16:00) to ensure timely departure.
Payment Terms
- Deposit and Balance Payment: For our premier 4- days, 3-nights charters, a 50% deposit is due at the time of booking, and the remaining 50% is due two weeks before
departure. - Our one-day excursions require full payment before bookings are confirmed (also see specific conditions below for our one – day excursions).
- Non-Payment and Cancellation by Client: Failure to pay the deposit within three days of booking will result in automatic cancellation. If the balance is not paid by the due date, the reservation will be canceled, and the deposit will be forfeited. Note: Cancellations are non-refundable, but clients may be able to file a claim through their travel insurance provider.
Cancellation by Halal Sailing Adventures
- Cancellation Policy: While cancellations are rare, we reserve the right to cancel due to force majeure (circumstances beyond our control). In such cases, we will notify the group organizer promptly and offer the following options:
○ Rescheduling: Adjust the booking to a future date based on availability.
○ Refund: Full refund of all payments made to Halal Sailing Adventures.
● Please note, refunds are limited to the booking fees paid and do not cover additional costs such as flights or transfers.
Force Majeure Events
“Force Majeure” refers to situations beyond our control that prevent service fulfillment, including
but not limited to:
● Natural disasters (extreme weather, earthquakes, floods)
● Acts of war, rebellion, terrorism, or civil unrest
● Radioactive contamination or other hazardous conditions
● Strikes, lockouts, or other labor disruptions
Should such events prevent us from fulfilling our services, Halal Sailing Adventures and its
personnel are not liable for service interruptions or associated damages.
Guest Responsibility and Liability Waiver
● Personal Belongings: We prioritize the security of personal items, but Halal Sailing Adventures is not liable for lost or stolen items. We recommend that all guests secure adequate travel insurance.
● Safety Briefing and Guest Responsibility: The skipper will conduct a mandatory safety briefing. Guests must understand and comply with safety protocols, and Halal Sailing Adventures will not be held liable for injuries caused by guest negligence.
● Assumed Risks: Sailing involves inherent risks (e.g., cuts, bruises, rope burns). Guests acknowledge these risks by boarding and agree to assume responsibility for potential injuries, excluding incidents caused by negligence or reckless disregard by Halal Sailing Adventures.
● Medical Condition: Each guest attests to their physical fitness, as confirmed by a qualified medical practitioner. Guests agree to accept medical treatment as necessary and assume responsibility for any costs.
Alcohol-Free Policy and Conduct Standards
- No Alcohol Policy: Halal Sailing Adventures is committed to an alcohol-free onboard experience. Guests agree to abstain from alcohol consumption while on board and to act in a manner respectful of others.
- Conduct: Behavior that is offensive or aggressive, or that damages the reputation of
Halal Sailing Adventures, may result in removal from the vessel without refund.
Security Deposit
● Deposit Amount: A security deposit of EUR 1,000 per group is required before embarkation for our 3 day 3 night premier charters. This will be reserved on the group leader’s credit card and will be released after final inspection, provided no damages or loss have occurred.
● Damage Responsibility: If damages are identified, costs will be deducted from the security deposit.
Crew List
Filled Form – Crew list – You are obliged to submit at least 3 days before the beginning of the charter and you guarantee that information is correct.
Onboarding Procedures
1. Yacht Inspection: Inspection with the group leader to confirm the yacht’s condition.
2. Orientation and Safety Briefing: Complete introduction to yacht facilities and safety equipment.
3. Settling In: Guests will be given time to settle in before departure.
Obligations of Halal Sailing Adventures
As per the registration of our yacht, at the Harbour Master’s Office, Cesarica III has all the standardized equipment and the minimum number of crew members, trained and possessing the required certification to operate.
Client Obligations and Tourist Tax
● Full Payment: Full payment must be received at least two months prior to boarding.
● Tourist Tax: Clients are subject to Croatian tourist tax, which is included in your total booking fee. Children under 12 are exempt, while guests aged 12-18 pay a reduced fee.
Food Allergy and Food Safety Disclaimer
Halal Sailing Adventures takes food safety seriously. However, we cannot guarantee an allergen-free environment.
● Allergen Responsibility: Guests must inform our team of any allergies or dietary restrictions during booking. Cross-contamination is possible due to shared preparation spaces.
● Liability: We are not responsible for allergic reactions if staff was not informed of the
allergy beforehand or if the guest assumed an allergen was absent without confirmation.
● Foodborne Illness: We follow food safety protocols; however, our liability does not extend to foodborne illnesses caused by improper storage or handling of food after it has been provided.
Jurisdiction
Halal Sailing Adventures and its clients agree to resolve disputes amicably. If resolution cannot be reached, disputes will be settled in the court of jurisdiction where Halal Sailing Adventures is registered.
SPECIFIC GENERAL CONDITIONS FOR ONE DAY EXCURSIONS
Note that all general conditions specified above have bearing on our one day excursions in addition to those stated below.
By booking with Halal Sailing Adventures, guests agree to all terms, including potential health, safety, and conduct expectations. We strive to make your experience seamless and safe, ensuring a memorable and enjoyable voyage.
1. Booking and Payment
● A reservation is confirmed upon receipt of [full payment .
● Payments can be made via [bank transfer, credit card, or other methods].
2. Pricing
● The price of the excursion includes:
○ Private use of the yacht for the specified duration.
○ Services of the skipper and hostess.
○ Halal meals, snacks, and beverages as specified.
○ Use of onboard facilities and equipment (e.g., snorkeling gear).
○ Fuel, marina fees, and any applicable taxes.
● Any additional services or upgrades not listed in the itinerary may incur extra charges.
3. Cancellation and Refund Policy
● By the Client:
○ Cancellations made more than [7 days] before the excursion will receive a [full/partial] refund.
○ Cancellations made less than [7 days] before the excursion are non-refundable.
● By the Company:
○ If the company cancels due to unforeseen circumstances (e.g., severe weather, mechanical issues), clients will receive a full refund or may reschedule their excursion.
4. Weather Conditions
● The skipper has the sole discretion to adjust the itinerary or cancel the excursion for safety reasons due to adverse weather. No refunds will be issued for itinerary changes, but alternative activities or destinations will be arranged where possible.
5. Client Responsibilities
● Clients must arrive at the departure point on time. Delayed arrivals may result in a shortened excursion with no refund.
● Guests are responsible for their personal belongings. The company is not liable for lost or damaged items.
● Any damage to the yacht or its equipment caused by guests will be charged to the client.
6. Health, Safety, and Conduct
● Guests must inform the crew of any medical conditions, allergies, or dietary restrictions at the time of booking.
● Life jackets and safety equipment are provided and must be used as instructed by the crew.
● Alcohol consumption and non-halal items are strictly prohibited onboard.
● The company reserves the right to terminate the excursion without refund if a guest engages in disruptive or unsafe behavior.
7. Insurance
● Guests are advised to have personal travel insurance that covers water activities.
● The yacht is insured for liability and marine risks.
8. Acceptance
By confirming a booking, the client acknowledges and agrees to these terms and conditions.
